These Terms of Service ("Terms") govern your use of the Zomi Association of Malaysia (ZAM) website located at www.zomimalaysia.org ("Website") and any related services provided by ZAM ("we," "us," or "our").

By accessing or using our Website and services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Website or use our services.

1. Services and Eligibility

1.1 Our Services

Zomi Association of Malaysia provides humanitarian services to Zomi refugees and vulnerable people in Malaysia, including but not limited to healthcare assistance, education, registration support, intervention services, and other community programs. Our Website provides information about these services and facilitates access to them.

1.2 Eligibility

You must be at least 18 years old to use our Website and services. By agreeing to these Terms, you represent and warrant that you are at least 18 years of age. If you are accessing our Website or services on behalf of a child or dependent, you must be their legal guardian or have appropriate permission.

2. Website Use and Limitations

2.1 Acceptable Use

By using our Website, you agree to use it only for lawful purposes and in accordance with these Terms. You agree not to use the Website:

  • In any way that violates any applicable Malaysian or international law or regulation
  • To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation
  • To impersonate or attempt to impersonate our organization, an employee, another user, or any other person or entity
  • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Website, or which may harm our organization or users of the Website

2.2 User Contributions

Our Website may contain message boards, chat rooms, personal profiles, forums, bulletin boards, and other interactive features (collectively, "Interactive Services") that allow users to post, submit, publish, display, or transmit content or materials (collectively, "User Contributions").

All User Contributions must comply with the content standards set out in these Terms. Any User Contribution you post to the site will be considered non-confidential and non-proprietary. 3.1 Website Content

The Website and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Zomi Association of Malaysia, its licensors, or other providers of such material and are protected by Malaysian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

3.2 Limited License

Subject to these Terms, we grant you a non-exclusive, non-transferable, revocable license to access and use the Website for your personal, non-commercial use. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Website, except as follows:

  • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials
  • You may store files that are automatically cached by your Web browser for display enhancement purposes
  • You may print or download one copy of a reasonable number of pages of the Website for your own personal, non-commercial use and not for further reproduction, publication, or distribution
  • If we provide social media features with certain content, you may take such actions as are enabled by such features

You agree to defend, indemnify, and hold harmless Zomi Association of Malaysia, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Website.

7. Changes to the Terms

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Website thereafter. Your continued use of the Website following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.

8. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the laws of Malaysia, without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Website shall be instituted exclusively in the courts of Malaysia. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

9. Waiver and Severability

No waiver by Zomi Association of Malaysia of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of our organization to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

10. Third-Party Links and Content

The Website may contain links to third-party websites or services that are not owned or controlled by Zomi Association of Malaysia. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We do not warrant the offerings of any of these entities/individuals or their websites.

You acknowledge and agree that Zomi Association of Malaysia shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such third-party websites or services.

11. Donations and Financial Contributions

When you make a donation or financial contribution to Zomi Association of Malaysia through our Website:

  • You represent and warrant that you have the legal right to use any payment method you provide in connection with the transaction
  • You acknowledge that all donations are non-refundable
  • You agree that your donation may be used to support any program or operational need of our organization, unless specifically designated for a particular program or purpose
  • You understand that we may issue receipts for eligible donations in accordance with applicable Malaysian laws

12. Volunteer Registration and Commitment

If you register to volunteer with our organization through our Website:

  • You agree to provide accurate and complete information during the registration process
  • You understand that submitting an application does not guarantee acceptance as a volunteer
  • You acknowledge that you may be subject to background checks and screening procedures
  • If accepted, you agree to abide by our Volunteer Code of Conduct, which will be provided during orientation
  • You understand that as a volunteer, you are not an employee of Zomi Association of Malaysia and are not entitled to compensation or employee benefits

13. Refugee Support Services

For beneficiaries of our refugee support services:

  • Registration with ZAM does not automatically confer UNHCR recognition or legal status in Malaysia
  • Our services are provided based on availability and assessment of need
  • You agree to provide accurate information regarding your situation and needs
  • You understand that our ability to provide services may be limited by resources and local regulations
  • We commit to maintaining confidentiality of sensitive personal information within legal boundaries

14. Entire Agreement

These Terms, our Privacy Policy, and any other documents incorporated by reference constitute the sole and entire agreement between you and Zomi Association of Malaysia regarding the Website and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Website.
